H. NSF Checks
- Insufficient or Non-Sufficient Funds (NSF) checks are defined as legally recognized banking instruments, such as checks, drafts, etc. utilized by individuals or corporations to draw upon funds deposited at the referenced banking institution, which have been returned, unhonored, to the Cooperative because insufficient funds exist in the account to cover the instrument, the account's assets have been frozen, or other legal action has been instituted disallowing drafting of the funds.
- Checks not honored by a financial institution will be classified as non-payment of electrical service and the account will be disconnected with proper notice.
- Proper notice will be by letter, giving the member at least five (5) days from mailing to make satisfactory payment or the service will be disconnected for non-payment.
- When a non-sufficient fund (NSF) check is received to avoid disconnect, the service may be disconnected without further notice. Cash payment may be required based on past history of NSF checks.
- A NSF fee will be applied to all NSF checks.
- In extreme cases, the Cooperative may sign a criminal complaint against habitual offenders with the appropriate States Attorney's office.
- These rules apply to non-sufficient fund ACH withdraws where applicable.
